1. Overview and definitions
Overview. The Art Bin is a marketplace that sells print‑on‑demand (POD) products made from artwork provided by independent artists. We connect buyers to printed products; printing, fulfillment, and shipping are performed by third‑party POD partners or in-house. By submitted artwork for listing on theartbin.com you agree to be bound by these terms.
Key definitions.
- Artwork: images, designs, photographs, or other creative works you upload.
- Listing: a product page on theartbin.com that offers a POD product made from Artwork.
- POD products: physical items produced on demand by our fulfillment partners (prints, framed prints, canvases, etc.).
- Artist earnings: the amount payable to you after base product cost, platform fees, and any applicable taxes or deductions.
2. Accounts and onboarding
Eligibility. You must be 18 or older to register as an artist. Provide accurate legal name, contact, and tax information when requested.
Account security. You must create an account to sell through The Art Bin. Keep your password and account details secure. You are responsible for all activity under your account.
Onboarding requirements. We may require identity verification, tax forms, or additional documentation before enabling payouts. Failure to provide required information may delay or block payments.
Cancellation: You may close your account at any time by closing your theartbin.com account and emailing info@theartbin.com to request that your content be removed. Existing orders will be fulfilled.
3. License and rights
What you grant. By uploading Artwork you grant The Art Bin a non‑exclusive, worldwide license to reproduce, print, display, distribute, and sell the Artwork only as POD products offered through theartbin.com. This license is limited to on‑site POD sales and does not transfer ownership or grant rights to sell other commercial licenses.
You retain ownership. You keep all copyright and other rights in your Artwork not expressly granted to The Art Bin.
Promotional use. You also grant The Art Bin a right to use low‑resolution images of your Artwork for marketing, promotion, and display on theartbin.com and related social channels. We will credit you where reasonably possible.
Duration. The license continues until you remove the Artwork or your account is terminated, except that existing orders placed before removal will still be fulfilled.
4. Pricing, payments, and taxes
Pricing. The Art Bin will work with you to establish pricing for your works and products. Final customer price equals production, shipping, and transaction fees plus artist markup. The Art Bin retains a commission on all sales consisting of 25% of the artist markup.
Fees. Transaction/payment processing fees are included in the base pricing. For the purposes of product pricing, transaction fees are estimated at 3%. Actual fees will depend on payment type and processor. Payouts will be calculated based on actual transaction fees.
Payouts. Artist earnings are paid monthly. Payout timing, minimum thresholds, and payment methods are shared during the artist on-boarding process. We may hold or offset payments for refunds, chargebacks, or suspected fraud.
Taxes. You are responsible for reporting and paying all taxes on earnings. We may collect tax forms and report payments to tax authorities as required by law. The Art Bin will collect and pay sales tax.
Sales and Discounts. Discounts will be offered for email list sign-ups, purchases of multiple items, volume pricing for businesses and art-buyers, and occasional sales. The discount will be shared evenly between The Art Bin and Artist (e.g., for a 10% discount, both parties’ payouts will be deducted by 5% of the total sale). This only applies to sales and discounts up to 15%. For any sales, discounts, or volume discounts over 15%, The Art Bin will absorb the amount above 15% or will consult with Artist prior to the sale.
5. Orders, fulfillment, and product quality
Order flow. When a customer orders a POD product, we forward the order to a POD partner who prints, packs, and ships the item. The POD partner is responsible for production and shipping. In some cases orders may be fulfilled and shipped in-house.
Shipping and delivery. Delivery times and shipping costs vary by product and destination. We provide estimated delivery windows but cannot guarantee carrier performance.
Quality standards. We expect files to meet our image and resolution guidelines. Images that fail to meet guidelines will be rejected and associated listings will be postponed until adequate imagery is provided.
Defects and returns. If a customer receives a damaged or defective item, they must contact us within 30 days with photos and order details. We will review and, if the claim is valid, arrange a reprint in accordance with our return policy. Artists are not responsible for production or shipping defects or costs associated with providing reprints.
Order cancellations. Orders cannot be canceled once production has started. If a cancellation is possible, refunds will be handled according to our refund policy.
6. Intellectual property, warranties, takedowns, and termination
Artist warranties. By providing Artwork you warrant that you own the Artwork or have all necessary rights and permissions to grant the license above and to sell POD products made from it. You warrant that the Artwork does not infringe third‑party rights and is not unlawful. You agree to provide valid and accurate model releases for any images that include recognizable real people.
You represent and warrant that:
-You have full right, power, and authority to enter into this agreement.
-The images and all parts thereof are owned and/or under your control, that they are unencumbered and original works and capable of copyright protection in all countries where such or similar protection is offered.
-If the images contain identifiable individual persons that you have acquired all rights to use such human likeness.
-If the images contain identifiable third-party trademarks that such use is licensed by the trademark owner or that such use is lawful under U.S. intellectual property laws
-Images do not infringe upon copyright or any other rights of any third party
-The images are not currently associated with any lawsuit, claim, or other legal action
Prohibited content. Do not submit content that is illegal, pornographic, hateful, defamatory, or that violates privacy or publicity rights.
Contributing artists represent and warrant that they own or have the rights to the work that is offered for sale on the website. We maintain a takedown and counter‑notice process for IP complaints that conforms with the Digital Millennium Copyright Act (DMCA) of 1998. We will remove content on valid notices. Repeat infringers may be suspended or terminated.
Takedown process. We respond to valid intellectual property complaints. Our process follows the Digital Millennium Copyright Act of 1998 (DMCA).
- Notice: Submit a written complaint with identification of the allegedly infringing material and a statement under penalty of perjury. Notice must comply with requirements of a DMCA notice.
- Removal: We will remove or disable access to the material if the notice is valid.
- Notification: We will notify the artist and provide the complainant’s contact information as required by law.
- Counter‑notice: If you believe the removal was mistaken, you may submit a counter‑notice in compliance with DMCA requirements; we will follow applicable law before restoring content.
Repeat infringers may be suspended or terminated.
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide a DMCA-compliant notice to info@theartbin.com. The notice must include all information required for a valid DMCA notice. Users that have received a DMCA-compliant notice may provide a counter notification that is also DMCA compliant. The Art Bin may terminate user accounts that have been the subject of five (5) separate DMCA notices. The Art Bin may also terminate user accounts that are subject to fewer than five (5) DMCA notices in appropriate circumstances (e.g., violating or willfully disregarding these or other website terms or policies).
Indemnity. You agree to indemnify and hold The Art Bin and its partners harmless from claims, damages, losses, and expenses arising from your Artwork, your breach of these terms, or your violation of law.
Termination and removal. You may remove listings or close your account at any time; existing orders will still be fulfilled. We may suspend or terminate accounts for breaches, suspected fraud, or other business reasons. On termination we may retain copies of records as required by law.
7. Liability, changes, and contact
Limitation of liability. The Art Bin provides the service “as is.” Our liability for any claim related to a product or order is limited to the purchase price paid for that order. We are not liable for indirect, incidental, special, or consequential damages.
Changes to terms. We may update these terms. We will post the updated terms on theartbin.com and, where required, notify you. Continued use after posting constitutes acceptance.
Governing law and disputes. These terms are governed by the laws of the State of Ohio and the United States. Dispute resolution procedures, including arbitration or small claims options, will be posted separately where required by law.
